NOTICE OF SALE
In accordance with that certain
Order entered in this cause by the
Honorable George K. Elbrecht,
Special Circuit Court Judge, on the
27th day of May, 2015, Summer
Scruggs the Circuit Clerk of Clarke
County, Alabama will sell at public
outcry on the court house steps in
Grove Hill, Clarke County, Alabama, between the legal hours of
sale (12:00 noon) on the 5th day of
August, 2015, the following described real property situated in
Clarke County, Alabama, subject to
the Court’s approval to-wit:
Parcel I:
Beginning at a point 30 feet
North of the SE corner of the SE ¼
of the NE ¼ of Section 4, Township
7 North, Range 2 East; thence
West 110.7 feet; thence North 1241
feet to a point 32 feet South of the
North boundary of said SE ¼ of NE
¼ ; thence East 110.7 feet to the
East boundary of said Subdivision;
thence North 2 feet; thence East
618 feet, more or less, to the NW
corner of a 10 acre lot heretofore
conveyed to Rhett Payne, Jr., and
wife Jean M. Payne by Rhett
Payne and wife, Eva M. Payne;
thence South along the West
boundary of said 10 acre lot 1243
feet to a point 30 feet North of the
South boundary of the SW ¼ of the
NW ¼ of Section 3; thence West
618 feet, more or less, to the point
of beginning. Containing 20.3
acres, more or less, and being a
part of the SW ¼ of the NW ¼ of
Section 3 and a part of the SE ¼ of
the NE ¼ of Section 4, all in Township 7 North, Range 2 East.

Parcel II:
Beginning at the Southwest corner of Lot number 149 in the old
Town of Jackson, Alabama thence
North forty-six degrees East along
Commerce Street 427.8 feet to the
place of beginning on the Lot to be
described; thence North forty-three
degrees thirty minutes West 54.4
feet, thence North forty-six degrees
thirty minutes East 25.9 feet,
thence South forty-three degrees
thirty minutes East 54 degrees to
Commerce Street, thence with said
street South forty-six degrees West
26.1 feet to the place of beginning,
being a part of lot number 146,
Jackson Alabama.

Parcel VI:
Parcel I of Parcel VI:
A tract of land located partly in the
SE ¼ of Section 7 and partly in the
NE ¼ of Section 18, Township 6
North, Range 2 East of the St.
Stephens Principal Meridian,
Clarke County, Alabama, described
as follows:
Beginning at the southeast corner of said Section 7, thence along
the eastern boundary of said Section 7 North 76.7 feet to the northwest boundary of right of way of the
Southern Railway Company, this
being point of beginning of boundary of tract of land herein conveyed, thence along said northwest
boundary of said right of way South
72 degrees and 30 minutes West
606.4 feet to the northeast bank of
the Tombigbee River, thence along
the bank of said river North 36 degrees and 35 minutes West 201.5
feet, thence North 43 degrees and
31 minutes west 329.0 feet, thence
leaving the bank of said river, North
44 degrees and 59 minutes East
1308.1 feet to intersection with the
eastern boundary of said Section 7,
thence along said eastern boundary South 1143.2 feet to point of beginning; the tract of land herein
conveyed having an area of 15.42
acres, more or less; reserving and
excepting, however, from the conveyance a right of way 25 feet in
width, parallel with, on the southeast side of and adjacent to the
northwest boundary of the tract of
land herein conveyed, said right of
way extending from the eastern
boundary of said Section 7 to the
northeast bank of the Tombigbee
River and being approximately
1308.1 feet in length; and further
excepting from the conveyance
such railroad tracts and rights of
way therefore as may be located
on and across the land herein conveyed and which are not owned by
the grantor herein.

LESS AND EXCEPT the following portions of said property conveyed:

Exception No. 1: Parcel by
Chester McCorquodale and wife
Jessie McCorquodale to J.M. Morgan and W.O. Morgan on September

24, 1928 by deed which is
recorded in the Office of the Judge
of Probate of Clarke County, Alabama, in Record Book 217 at page
438.

Exception No. 2: Parcel conveyed by Chester McCorquodale
and wife, Jessie McCorquodale to
National Butane Company of Jackson, Alabama, on August 18, 1944,
by deed which is recorded in the
Office of the Judge of Probate of
Clarke County, Alabama, in Record
Book 308 at page 523.

Parcel II of Parcel VI. That portion of the SE ¼ of Section 7, Township 6 North, Range 2 East,
bounded and described as follows:
Commencing at the southeast
corner of said Section 7, thence in
a northerly direction along the eastern boundary of said section
1219.9 feet to the point of beginning of the tract herein described,
which point is marked by a three
inch galvanized iron pipe, known as
Chickasaw Land Company Corner
No. 33, thence continuing in a
northerly direction along said eastern boundary of said Section 7,
406.7 feet to a point, which point is
marked by a three inch galvanized
iron pipe, known as Chickasaw
Land Company Corner No.1,
thence South 59 degrees and 37
minutes west 693.9 feet to a two
inch iron pipe, thence South 44 degrees and 59 minutes west 896.94
feet to the Tombigbee River, thence
in a southeasterly direction with
said river 462 feet to a point, which
point is known as Chickasaw Land
Company Corner No. 12 and which
point is South 44 degrees and 59
minutes West from the point of beginning, thence North 44 degrees
and 59 minutes East from said
point 1308.1 feet to the point of beginning.

SUBJECT, HOWEVER, to all restrictions and limitations upon the
title of grantor, including but not limited to those which are set forth in
the conveyance of said property
made by Chickasaw Land Company to Chester McCorquodale on
February 9, 1926 by deed which is
recorded in said Probate Office in
Record Book 237 at page 189, it
being the intention of party of the
first part to convey and she does
hereby convey to parties of the
second part the entire parcel of
land which is not being used by
grantees as a mill site, together
with all lands owned by grantor
contiguous thereto, and all easements owned by grantor to connection therewith, whether
embraced within the foregoing description or not, but subject to all
limitations and restrictions under
which grantor holds title thereto.
Said parcels containing 38.62
acres more or less.
Payment is due and payable to
the Circuit Clerk of Clarke County,
Alabama by the highest bidder at
the conclusion of the sale.
