Jackson mayoral candidate indicted Jackson mayoral candidate Michael Devane Overton was indicted a couple of weeks ago by the Clarke County Grand Jury on felony charges of credit card fraud. According to Jackson Police Investigator Richard Harvey, on Jan. 11, Baldwin County resident Jacqueline Mott reported that a credit card, which she did not apply for, had been issued by Providian Bank in her name. The bill for the card was reportedly being sent to 104 Eva Lane, which is an address where Overton receives mail. "When we confronted Mr. Overton concerning this matter he denied any involvement," said Harvey. "The card was issued in 2005, so someone has been paying the bill since that time." Harvey explained that Mott had signed on a loan with Overton sometime before the card was issued. "That's how we believe he (Overton) was able to obtain her personal information," he said. "We subpoenaed the credit card records and his checking accounts and found he was paying the bill out of his own account. He claimed someone had stolen his checkbook and was using his checks to pay the bill." Additionally, Harvey said apparently one or more payments were late and the credit card company notified Mott, who at that time became aware of the situation. He added that Overton had never reported his checkbook as being stolen. An indictment is merely an accusation of wrongdoing and Overton is assumed innocent unless he pleads guilty or is found guilty in a court of law.
An indictment does not prohibit him from seeking elected office but if he were to be elected and then be found or plead guilty, he would be removed from the office.
